1. Applicability  

These general terms and conditions apply to all agreements, offers, and services between Herst Verhuur and the customer regarding the rental of restroom trailers.  

 

2. Rental Period and Reservations  

2.1 The rental period starts on the agreed date and ends on the agreed end date, unless otherwise agreed in writing between the lessor and the lessee.  

2.2 Reservations are handled based on availability and must be made in a timely manner.  

2.3 The lessee must immediately inform the lessor of any changes to the reservation.  

 

3. Obligations of the Lessor  

3.1 The lessor ensures that the restroom trailer is in good condition and functioning properly at the time of delivery.  

3.2 If a defect or malfunction occurs during the rental period, the lessor will make every effort to resolve it as soon as possible.  

3.3 The lessor is not liable for any damage, loss, or inconvenience caused by a defect or malfunction of the restroom trailer.  

 

4. Obligations of the Lessee  

4.1 The lessee is responsible for the proper use and maintenance of the restroom trailer during the rental period.  

4.2 The lessee must ensure that the restroom trailer is placed in a suitable and accessible location, in accordance with the instructions of the lessor.  

4.3 The lessee is liable for any damage to the restroom trailer during the rental period, unless the damage is due to normal wear and tear or a defect that cannot be attributed to the lessee.  

 

5. Payment  

5.1 The lessee must pay the rental price and any additional costs, such as transport and cleaning fees, according to the agreed payment terms.  

5.2 In the event of a reservation cancellation, the lessor may charge cancellation fees unless otherwise agreed in writing.  

5.3 If the lessee fails to meet payment obligations, the lessor reserves the right to suspend further services and take any necessary collection measures.  

 

6. Liability  

6.1 The lessor is not liable for any damage or injury caused by the use of the restroom trailer unless such damage or injury results from intent or gross negligence on the part of the lessor.  

6.2 The lessee is liable for any damage or injury caused by improper use or misuse of the restroom trailer during the rental period.  

 

7. Force Majeure  

7.1 In cases of force majeure, such as natural disasters, strikes, fires, or other unforeseen circumstances, the lessor is not liable for failing to meet obligations.  

7.2 In the event of force majeure, the lessor will make every effort to inform the lessee as soon as possible and find a suitable solution.  

 

8. Disputes  

8.1 Any disputes between the lessor and the lessee shall initially be submitted to the competent court in the jurisdiction where the lessor is established.  

8.2 Dutch law applies to the agreement.
